1. The agreement
ClaimedTurf is operated by ClaimedTurf (“ClaimedTurf”, “we”, “us”). “You” means the business subscribing to our service and anyone using the leads on its behalf. Our service is sold to businesses for business use only. It is not offered to consumers.
You agree to these terms when you check the agreement box on our claim form, complete payment, or use any lead report we send you, whichever comes first. If you do not agree, do not subscribe and do not use the reports. Our Privacy Policy is part of this agreement.
2. What we provide
A ClaimedTurf subscription covers one trade category in one territory. Each week we deliver, by email, a report of scored leads for that trade and territory. A lead is a property where public permit records and related property data indicate likely demand for your trade, together with any owner contact information we were able to locate and check, and a short explanation of why the property was selected.
Reports are built from public permit records issued by local governments and from licensed third-party property and contact data. We sell the analysis and the packaged lead. We do not sell, and you do not receive, our suppliers’ raw records.
3. Exclusivity, exactly what it means
While your subscription is active and paid, we will not sell a subscription for the same trade category in the same territory to anyone else. We enforce this in our checkout system, not just as a policy: a claimed territory cannot be purchased by another customer in the same category.
Exclusivity does not mean:
- That other trade categories are excluded. We sell each territory to one customer per category (for example, one roofing company and one restoration company can each hold the same territory).
- That no one else can learn about these properties. Permit records are public. Other companies and other lead services may obtain the same public information from other sources. We promise not to sell it to your competitors in your category; we cannot promise that no competitor will ever find it.
- That the territory or category definitions are frozen. Territories are defined by ZIP-code groups and categories by trade keywords in our configuration. If we need to adjust a boundary or category, we will tell you by email at least 30 days in advance, and you may cancel before the change takes effect.
Exclusivity ends when your subscription ends, including at the end of a billing period after you cancel, or after an unresolved failed payment (Section 6). A released territory may be offered to another business in your category.
4. Founding rate
A limited number of founding subscriptions per metro (5) are sold at $299/mo per month instead of the standard $499/mo per month. The founding rate is locked for as long as that subscription stays continuously active and paid. If the subscription lapses for any reason, including cancellation or unresolved non-payment, the founding rate ends and is not re-offered for that territory. Additional trade categories are billed separately at the add-on rate shown at checkout (currently $399/mo per month) and never at the founding rate.
5. Lead-data use rules
The short version: the leads are for your own company’s outreach, by hand. No autodialers, no robocalls, no bulk texting, no reselling, and stop when someone asks you to stop.
You may use the leads only to market your own services to the listed property. You agree that you will:
- Dial manually. Any call or text to a phone number we provide must be placed by a person, one at a time. You will not use an automatic telephone dialing system, predictive dialer, prerecorded or artificial voice (including AI voice), or any bulk or automated text-messaging tool with numbers from our reports.
- Comply with calling laws. You are responsible for complying with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the National Do Not Call Registry rules, and every state telemarketing and do-not-call law that applies to you, including calling-hour limits, caller identification requirements, and your own company-specific do-not-call list. We check the numbers we provide against the National Do Not Call Registry and the state registries available to us at the time each report is generated, and we record when each check was made. That check helps you; it does not replace your own compliance obligations.
- Honor opt-outs. If a property owner asks you not to contact them, stop immediately and tell us at privacy@claimedturf.com so we can suppress that contact in future reports.
- Keep it inside your company. You will not resell, sublicense, share, publish, or redistribute lead reports or any information in them to anyone outside your business, and you will not combine them into any product or list offered to others.
- Use it only for marketing. Our reports are not consumer reports and we are not a consumer reporting agency. You will not use any information we provide to decide whether someone is eligible for credit, insurance, employment, housing, or any other purpose covered by the Fair Credit Reporting Act.
- Be responsible for your people. These rules apply to your employees, subcontractors, call centers, and anyone else you give the leads to. Their violations are your violations.
Violation of this section is a material breach. We may suspend or terminate your subscription immediately and without refund (Section 10), and you remain responsible under Section 9.
6. Billing
- Subscriptions are billed monthly, in advance, to the payment method you provide through our payment processor, Stripe. Your subscription renews automatically each month until cancelled.
- Prices exclude any applicable taxes. If we are required to collect tax on your subscription, it will be added to your invoice.
- We may change the standard or add-on price with at least 30 days’ notice by email. A locked founding rate is not affected by a standard-price change while it remains locked (Section 4).
- If a payment fails, it will be retried. If the payment is not resolved within 14 days, we may suspend delivery and release your territory. Keep the email on your subscription current so payment notices reach you. A territory released for non-payment is treated as a lapsed subscription, including for the founding rate.
- If you believe a charge is wrong, contact us before disputing it with your bank. We resolve billing errors promptly.
7. Cancellation and refunds
- Cancel anytime. Email hello@claimedturf.com from the address on your subscription. We confirm cancellations within one business day.
- Effective at the end of the current billing period. You keep receiving reports, and your exclusivity holds, through the last day of the period you have already paid for. Your territory is released after that.
- No refunds or partial-period credits. Because the territory is reserved for you and leads are delivered from the first week, subscription fees are non-refundable, and unused portions of a billing period are not prorated or credited.
- Founding rate is lost on cancellation. Reactivating later is at the price then in effect, subject to the territory being available.
- The only exception is Section 10: if we discontinue your metro or terminate your subscription without cause, we refund the unused portion of the current period.
8. Accuracy, volume, and what we do not promise
We work hard to make every lead useful, and we want to hear when one is not. But lead data comes from government records and third-party sources that can be incomplete, delayed, or wrong, and property owners change. So:
- We do not guarantee that any lead is accurate, current, reachable, interested, or will become a job. Some leads will be homeowners who already hired someone.
- Lead volume follows real permit activity. Territories are sized to deliver roughly 8 to 15 leads per week on average, but a quiet week, a storm week, or a jurisdiction that pauses publishing can move that number in either direction. We do not guarantee a minimum count.
- If a data source we depend on becomes unavailable, we will tell you and may pause delivery for the affected territory. If a pause lasts more than 14 consecutive days, you may cancel with a refund of the unused portion of the current period.
- The service and every report are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability and indemnification
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the service or these terms is limited to the subscription fees you paid us in the three months before the event giving rise to the claim. We are not liable for lost profits, lost jobs, lost data, or any indirect, incidental, special, consequential, or punitive damages, even if we were told they were possible.
You will defend, indemnify, and hold harmless ClaimedTurf and its owner from any claim, demand, fine, penalty, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the leads or your breach of these terms, including any claim under the Telephone Consumer Protection Act, the Telemarketing Sales Rule, or any federal or state do-not-call, telemarketing, privacy, or consumer-protection law.
10. Termination and discontinuation
- For breach. We may suspend or terminate your subscription immediately if you violate Section 5, use the service unlawfully, or fail to pay. No refund is owed for a termination for breach.
- Without cause, or discontinuing a metro. We may end your subscription or stop serving a metro with at least 30 days’ notice. In that case we refund the unused portion of the current billing period.
- On termination for any reason, your right to use the reports for new outreach ends and your territory is released.
11. Reports, feedback, and intellectual property
The reports, scoring, and everything we produce are owned by ClaimedTurf. You receive a limited, non-transferable license to use them inside your business, for the purposes in Section 5, while you subscribe. The public permit records underlying the reports remain public; our selection, scoring, enrichment, and presentation are ours.
When you tell us how a lead turned out (for example, using the “Won this job” links in a report), you grant us the right to use that feedback to improve our scoring and service. We use it in aggregate and never disclose your win rate or your customer names to anyone else.
12. Changes to these terms
We may update these terms. For material changes we will email the address on your subscription at least 14 days before the change takes effect and update the version number at the top of this page. Continuing to subscribe after the effective date means you accept the updated terms. If you do not accept them, cancel before that date.
13. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and the state and federal courts located there have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief anywhere to stop misuse of the leads.
Before starting any formal proceeding, you agree to email us and give us 30 days to resolve the issue informally. Most problems are a data question or a billing mistake, and we fix those quickly.
